Welcome to One Third. These Terms of Service (“Terms”) govern your access to and use of onethirddream.com (the “Site”) and your purchase of products offered by One Third Holdings LLC (“One Third,” “we,” “us,” or “our”).
By accessing or using our Site, placing an order, or otherwise interacting with our services, you agree to these Terms. If you do not agree with these Terms, please do not use the Site.
1. Eligibility
By using this Site, you represent that you are at least the age of majority in your state of residence or are using the Site with the permission and supervision of a parent or legal guardian.
2. Online Store Terms
You may not use our products, Site, or services for any unlawful or unauthorized purpose or violate any applicable laws in connection with your use of the Site.
You agree not to reproduce, duplicate, copy, sell, resell, exploit, or otherwise use any portion of the Site or its content without our express written permission.
3. Products
We make reasonable efforts to display product descriptions, fragrance information, colors, packaging, photographs, and other product details as accurately as possible.
However, colors and appearance may vary depending on your device or display settings, and minor variations may occur between product batches or packaging.
We reserve the right to modify, discontinue, limit, or update products at any time without prior notice.
4. Orders
All orders are subject to acceptance and availability.
We reserve the right to refuse, limit, or cancel an order when reasonably necessary, including in cases involving suspected fraud, unauthorized activity, inventory limitations, pricing or product information errors, or other circumstances that may affect our ability to fulfill an order.
If we cancel an order after payment has been processed, we will issue the appropriate refund to the original payment method.
5. Pricing and Payment
Prices are displayed in U.S. dollars unless otherwise stated.
Applicable taxes and shipping charges, if any, will be displayed during checkout.
We reserve the right to correct pricing, typographical, or other errors appearing on the Site. If an error affects an order you have already placed, we may contact you regarding the error or cancel and refund the affected order.
Payments are processed through Shopify and/or third-party payment providers. One Third does not directly store complete payment card information where payment processing is handled by such providers.
6. Shipping
One Third currently ships within the United States only.
Orders are generally processed within up to five (5) business days, excluding weekends and holidays.
Complimentary standard shipping is available on eligible U.S. orders of $75 or more, calculated before applicable taxes and after discounts unless otherwise stated at checkout.
Shipping and delivery estimates are provided for convenience and are not guaranteed. Carrier delays, weather conditions, holidays, incorrect addresses, or circumstances outside our reasonable control may affect delivery.

7. Returns and Refunds
Eligible products may be returned within 30 days of delivery, provided that the product is unused, unopened, and remains in its original packaging.
Opened or used products are not eligible for return.
Discovery Sets may be returned within the 30-day return period only if the Discovery Set remains unopened and unused.
For eligible returns approved by One Third, we will provide return shipping at no charge to the customer. Original shipping fees, if any, are non-refundable.
Products that arrive damaged, leaking, defective, or incorrect may qualify for a replacement or refund.

8. Product Use and Disclaimer
One Third products are fragrance and lifestyle products designed to complement personal spaces and nighttime rituals.
Our products and the information provided on this Site are not intended to diagnose, treat, cure, or prevent any disease or medical condition, including insomnia, anxiety, sleep disorders, or other health conditions.
Statements regarding relaxation, winding down, nighttime rituals, atmosphere, fragrance experience, or similar concepts describe the intended sensory or lifestyle experience of our products and should not be interpreted as medical advice or a guarantee of any particular sleep or health outcome.
Individual fragrance experiences and sensitivities vary.
Customers should use products according to the instructions provided with the product or on the Site and discontinue use if irritation or an adverse reaction occurs.
9. Intellectual Property
All Site content, including the One Third name, trademarks, logos, graphics, product names, fragrance names, packaging designs, photographs, videos, text, illustrations, design elements, and other materials, is owned by or licensed to One Third Holdings LLC and is protected by applicable intellectual property laws.
No content may be copied, reproduced, distributed, modified, published, or commercially used without prior written permission from One Third.
10. Third-Party Services
Our Site is hosted through Shopify and may use third-party service providers to support payments, fulfillment, communications, marketing, analytics, and other business operations.
Your use of certain third-party features or services may also be subject to the applicable third party’s terms and privacy practices.
11. Email and SMS Communications
If you choose to subscribe to One Third marketing communications, you may receive promotional emails and/or text messages regarding products, launches, offers, events, and other One Third news.
Consent to receive marketing communications is not a condition of purchase.
You may unsubscribe from marketing emails using the unsubscribe link contained in our emails.
For SMS marketing, you may opt out by following the opt-out instructions contained in our messages, such as replying STOP, where supported.
Message and data rates may apply. Message frequency may vary.
Transactional communications relating to orders, shipping, account activity, or customer service may still be sent when necessary.
12. Prohibited Uses
You may not use the Site to engage in unlawful activity; violate intellectual property rights; submit false or misleading information; transmit malicious software; attempt unauthorized access to our systems; interfere with Site security; collect information about others without authorization; or otherwise misuse the Site.
13. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Site and its content are provided on an “as is” and “as available” basis.
We do not guarantee that access to the Site will always be uninterrupted, timely, secure, or error-free.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded under applicable law.
14. Limitation of Liability
To the fullest extent permitted by applicable law, One Third Holdings LLC and its officers, members, employees, agents, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or products.
Nothing in these Terms is intended to limit liability that cannot legally be limited under applicable law.

15. Governing Law
These Terms and your use of the Site will be governed by the laws of the State of New York, without regard to conflict-of-law principles, except where applicable consumer protection law requires otherwise.
Any arbitration provision, jury-trial waiver, class-action waiver, or mandatory forum-selection clause should be added only after review by One Third’s attorney.

We may update these Terms periodically to reflect changes in our business, services, practices, or legal obligations.
The updated version will be posted on this page with a revised “Last Updated” date.
